Terms and Conditions

By booking with Vicki Luck Photography you enter into a contract and have therefore agreed to abide by the following terms and conditions.

1) APPLICABLE LAW

a) The laws of England and Wales shall govern this agreement.

b) These Terms and Conditions shall not be varied except by prior agreement of Vicki Luck Photography in writing.

2) PRIVACY POLICY

a) The Client accepts the Vicki Luck Photography Privacy Policy.

3) SESSIONS

a) Deposits are non-refundable except in the event Vicki Luck Photography cancels the booking.

b) The Client understands and accepts that the photographic coverage will be as Vicki Luck Photography’s professional expertise determines. Special requests are not binding instructions although every effort is made to comply with the Client’s wishes.

c) If the Client fails to read information supplied on the Vicki Luck Photography website, and therefore fails to carry out required preparations prior to a photography session, Vicki Luck Photography will not be held responsible for any resulting reductions in quality or quantity of images supplied.

d) If the Client fails to read information supplied on the Vicki Luck Photography website, and does not allow enough time for the session, Vicki Luck Photography will not be held responsible for any resulting reductions in quality or quantity of images supplied.

e) If the Client is more than 15 minutes late for a session without communication the session will be cancelled without refund of deposit.

4) IMAGE PRODUCTION AND HANDLING

a) Although Vicki Luck Photography will do its best to capture and edit the quantities listed on the website, there is no guarantee that any particular number of images will be produced.

b) Vicki Luck Photography shall use judgement regarding the style and artistic input in the production of images. This includes but is not limited to locations, poses, and number of images taken. Due to willingness of subjects it may not be possible to capture all the images requested, or images to the clients full expectations.

c) Vicki Luck Photography shall use judgement to select to best images to provide to the Client. Images may be discarded based on lighting, expression, eyes being open, etc.

d) In the event of uncooperative children Vicki Luck Photography may not be able to capture the requested or expected images. The Client is responsible for children during all sessions.

e) Vicki Luck Photography fully edits all images before presenting to the Client. Additional edits are carried out at the discretion of Vicki Luck Photography, and Vicki Luck Photography reserves the right to charge the Client for additional editing to cover time involved, at a rate of £15 per image.

f) Vicki Luck Photography edits images using a regularly calibrated monitor. Vicki Luck Photography will not be held responsible for variances in images caused by clients viewing images on non calibrated screens.

5) ALLERGIES

a) Vicki Luck Photography will not be held liable for any adverse effect, illness, or allergic reaction to food or drink consumed during sessions whether supplied by Vicki Luck Photography or not.

b) Vicki Luck Photography will not be held liable for any adverse effect, illness, or allergic reaction as a result of contact with materials (for example reactions to washing powder, paint, or any food consumed in the studio), although every reasonable effort is made to prevent this.

c) Allergy details must be communicated before visiting the studio, especially for Cake Smash sessions where allergy details will be passed directly to the cake supplier. It is the responsibility of the parent to read and understand the ingredient list provided with the cake before consumption.

6) CAMERA POLICY

a) Clients are not permitted to take photos during any session without the express permission of Vicki Luck Photography.

7) FULFILLMENT OF OBLIGATIONS

a) Vicki Luck Photography shall not be liable to the Client for any failure, in whole or in part, to fulfil its obligations where failure arises as a result of an event or circumstances beyond its control, which may include (but are not limited to) equipment failure, inclement weather, illness or injury.

b) In the unlikely event of total photographic failure or cancellation of the contract by either party or in any other circumstances the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential losses.

8) RECEIPT OF IMAGES

a) The images are presumed to have been received in good condition unless the Client notifies Vicki Luck Photography in writing of any discrepancy or error within 5 working days of Client login to the Downloads area of the website.

9) IMAGE COPYRIGHT

a) Vicki Luck Photography images shall not be edited without prior written permission of Vicki Luck Photography.

b) It is illegal to remove a watermark from any Vicki Luck Photography image.

10) PRODUCT COOLING OFF PERIOD

a) Because the supply of any products purchased (prints, canvas, etc.) have been ordered to the Client’s personal specification and using the Client's personal images, the Client does not have the right to a cooling off period.

b) By placing an order with Vicki Luck Photography you are committing to buy the ordered products.

11) PRODUCT RETURNS POLICY

a) Incorrectly supplied items and items of poor quality can be returned and will be replaced at no extra charge to the Client.

b) Faulty items should be returned to Vicki Luck Photography. The Client is responsible for any costs associated with return postage.

c) Returns will not be considered for incorrectly ordered items or items ordered in error.
